Terms of Service (Clock Forest)

1. Introduction

These Terms of Service ("Terms") govern your use of Clock Forest (the "App"), provided by Nagilit Labs ("we," "us," or "our").

You must be an adult — 18 or older, or the age of majority where you live — to accept these Terms or to make a purchase. A parent or legal guardian must review and accept these Terms before a child uses the App. If you do not agree to these Terms, do not use the App.

Our handling of information is described in the Privacy Policy, which forms part of these Terms.

2. Who May Use the App

The App is designed for children ages 4 to 8 to use with the supervision of a parent or legal guardian.

• Parents and guardians are responsible for supervising a child's use of the App and device settings.
• No account registration is required.
• The App requires a compatible iOS or Android device.

3. Local App Data

Game progress, settings, and the local record of unlocked content are stored on the device. The App does not provide cross-device synchronization for game progress.

You can delete an individual save slot from inside the App, and deleting the App may delete all locally stored game data. Purchase restoration is available through the applicable store account, subject to the store's rules and availability.

4. One-Time In-App Purchase

Levels 1–2 are available without payment. A one-time in-app purchase unlocks levels 3–6. This is a single purchase, not a subscription, and nothing renews automatically.

• Prices and purchase terms are shown by the Apple App Store or Google Play and may vary by region.
• Purchases must be made with a parent's or legal guardian's authorization. The App uses a parent gate before the purchase flow.
• Payments are processed by the applicable store. We do not receive payment-card information.
• Refunds are governed by the relevant store's policy. For the App Store, request a refund at reportaproblem.apple.com. For Google Play, use the Google Play refund request process.

5. Intellectual Property and License

All intellectual property rights in the App and its content, including text, graphics, audio, characters, and game systems, belong to us or the applicable rights holders.

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Apple's standard Licensed Application End User License Agreement also applies to your use of the App on Apple devices, and where it conflicts with these Terms, the terms that give you greater protection prevail. These Terms are between you and us only. Apple Inc. and Google LLC are not parties to these Terms and are not responsible for the App.

6. Prohibited Activities

You must not misuse the App, violate applicable law, attempt unauthorized access, reverse engineer the App except where law permits, interfere with normal operation, or infringe third-party rights.

7. Disclaimers

The App is designed to support learning through play, but we do not guarantee a particular educational outcome, skill level, or result.

To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the App, and our total liability is limited to the amount you paid for the App in the twelve months before the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from our willful misconduct or gross negligence. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

9. Changes, Suspension, and Termination

We may update, modify, suspend, or discontinue App features when reasonably necessary for maintenance, improvement, security, legal compliance, or other operational reasons.

You may stop using the App at any time by deleting it. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — continue to apply.

10. Governing Law

These Terms are governed by the laws of Japan. Nothing in these Terms affects mandatory consumer rights in your jurisdiction, or protections you have under the laws of your U.S. state or other home jurisdiction. Where mandatory law allows, you may bring claims in your country of residence, and non-waivable local consumer protections continue to apply.

If something goes wrong, please contact us first — we would rather resolve it directly than through a court.

11. Changes to These Terms

We may update these Terms. Updated Terms take effect when posted on this page. For material changes, we may provide notice through App update information.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and Apple's standard Licensed Application End User License Agreement where it applies, are the entire agreement between you and us about the App, and replace any earlier version. If we do not enforce a provision immediately, we do not waive it. We may assign these Terms as part of a merger, acquisition, or sale of the App, and your rights under them carry over unchanged.
